Rules & Requirements
NO PURCHASE IS NECESSARY TO ENTER OR WIN THE BARKMAGAZINE.COM CONTEST.  PURCHASING WILL NOT INCREASE YOUR CHANCES OF WINNING.

ENTRANT MUST BE A BARKMAGAZINE.COM MEMBER, 18 YEARS OF AGE OR OLDER, AND A LEGAL RESIDENT OF THE UNITED STATES.  VOID WHERE PROHIBITED BY LAW.
1. HOW TO ENTER:  No purchase necessary to enter or win.  Contest starts on October 1st, 2008 and shall continue indefinitely until further notice on this website (the “entry period”).  You may enter by submitting digital photos as set forth below.  NO ENTRIES BY MAIL WILL BE PERMITTED.

No more than ONE photo entry per member per calendar month.

DIGITAL ENTRIES:
Only digital photos will be accepted.  These may be submitted online via email This e-mail address is being protected from spambots. You need JavaScript enabled to view it .  Please adhere to the provided instructions when uploading your entry.  Digital file entries may not exceed 2MB in size and must be uncompressed jpeg files having a resolution of 72dpi or 600x800 pixels.  In the event your image is selected for consideration as a finalist, you will be asked to provide a high-resolution file for purposes of possible publication.

Entry may not be offensive, nor may the subject matter reflect a scenario that is harmful to the animal depicted in the photo, nor can it defame or invade the publicity rights or privacy of any person, or otherwise infringe upon any person or entity’s personal or proprietary rights, as determined by the judges in their sole discretion.  Incomplete entries and entries not complying with all rules are subject to disqualification.  No correspondence regarding entries will be acknowledged or entered into with entrants.  By entering, each entrant forfeits to Sponsor all rights to the content of his/her entry (but shall retain copyright in the photograph, subject to a license in favor of Sponsor, as explained below).  Entries become the sole property of the Sponsor and will not be returned, even with a self-addressed stamped envelope

JUDGING CRITERIA:  All entries will be judged by a qualified panel of judges approved by Sponsor.  This is a subjective opinion of the judges and the judges’ decision s final. Winners will be selected at least monthly, with the judging taking place just before each winner is announced.

PRIZES:  At least one (1) Contest winner per month:  Winning photos will gain national exposure on BarkMagazine.com after the winner has signed a photo release form.  If a third party should contact Sponsor for information about the dog featured in any photo submitted or the photographer of the photo, Sponsor will not share any personal information about that dog, dog owner, or photographer with such third party, but will contact the individual who submitted the photo with a message from the third party.  Winners will also receive a free year Membership to the BarkMagazine.com website.  Prizes consist of only those items specifically listed herein as part of the prize.  All taxes and other expenses incurred are the winner’s sole responsibility.  Limit one prize per person or household. Sponsor reserves the right to substitute a prize of comparable or greater value if the above prize becomes unavailable.  No substitution, cash equivalent or transfer of prize permitted.
2. ELIGIBILITY:  Open to all legal U.S. residents who are members of BarkMagazine.com and are 18 years of age or older.  Employees, volunteers, interns and agents of BarkMagazine.com and its parent companies, affiliates, subsidiaries, and advertising and promotion agencies, and their immediate families (spouse, parents, children, and siblings and their respective spouses) and individuals living in the same households of such persons are ineligible to enter or win.  Void where prohibited by law.  Contest subject to all applicable federal, state, and local laws and regulations.  By participating, entrants agree to be bound by these Official Rules and accept decisions of the Sponsor as final in all matters relating to this Contest.

BarkMagazine.com and its parent companies, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective employees, officers, directors, shareholders, and agents (collectively, “Releasees”) are not responsible for incorrect or inaccurate transcription of entry information or any other error or malfunction.  Entry materials that have been tampered with or altered are void.  Proof of mailing entry does not constitute proof of delivery.

If the judges determine, in their sole discretion, that there is any suspected or actual tampering with the Contest, fraud, violation of the Official Rules, or if technical failures or difficulties compromise the integrity of the Contest, the judges reserve the right to void the entries at issue and/or terminate the Contest (or any portion thereof) and judge those eligible entries received as of the action requiring such termination.  If the Contest is terminated prior to its expiration date, notice will be posted at www.barkmagazine.com.  Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by the Sponsor, Releasees and/or their agents.
3. TO CLAIM PRIZE:  Winners will be notified by email each month, and may be required to complete and sign an Affidavit of Eligibility and a Liability Release and, where legal, Publicity Release, which must be returned within seven (7) days of issuance of prize notification.  If the affidavit and release(s) are not returned within the time period, properly executed or are returned as undeliverable, the prize will be forfeited and awarded to an alternate winner.
4. LIMITATIONS:  Releasees are not responsible for any typographical or other errors in printing, the offering or administration of the promotion, or in the announcement, awarding or acceptance of prizes.  Releasees have no liability whatsoever for any injuries, losses, or damages of any kind resulting from acceptance, possession, use or misuse of any prize or participation in this Contest (including, without limitation, any activity related hereto).
5. GENERAL CONDITIONS:  By participating, entrants irrevocably assign and transfer all rights, titles and interest in and to the entry and grant the Sponsor an irrevocable, royalty-free, non-exclusive, perpetual license to the photograph (and its related intellectual property rights, including copyrights), including the right to use, display, perform, modify, reproduce, and distribute the photograph, in any medium.  Upon issuance of notification by Sponsor, winners must provide any releases for photograph(s) required by Sponsor within 7 days of issuance of request or winner will be disqualified.  Winners are responsible for the payment of taxes on prizes and for any other expenses relating to use of prizes.  Winners consent to the use of their name, likeness and/or photograph for promotional purposes, including online announcements, without additional compensation, except where prohibited by law.  Entrants agree that their entry (including the photo) will be owned by the Sponsor, and its designees shall have the right to publish, use, adapt, edit and/or modify such entry in any way (including in commerce), and in any and all media worldwide, including but not limited to the internet, without limitation and without compensation to the entrant.  Entrants represent that they own all right, title and interest in and to each of their entries, and the Sponsor’s use thereof will not infringe upon the rights of any third parties.  Entrants shall indemnify, defend and hold harmless the Releasees from any and all third party claims arising out of or relating to Sponsor’s use of their entries.
6. WHO WON?  The names of the winners will be available after The First Day of each month and winning photos will be posted on our website, and are available by mail by sending a self-addressed, stamped envelope to:
